Paul Cosgrave, S.C.

Paul Cosgrave, S.C. practises predominantly in commercial law, advising upon and appearing in Supreme and Federal Court cases both in Victoria and interstate. He has experience in a variety of areas: professional negligence claims involving auditors, accountants, engineers and lawyers; actions for and against the ACCC regarding the restrictive trade practices provisions of the Trade Practices Act; cases involving superannuation issues, including claims regarding the establishment and operation of superannuation funds and the distribution of surpluses; recovery actions both for and against banks and lending institutions; disputes regarding directors and their duties.

Other areas of practice are building/construction law and administrative law. The former includes court actions and arbitrations regarding building disputes and the latter covers appearances in both the Federal Court and AAT.

Two particular areas of interest are company law, especially in an insolvency context, and superannuation law. He is a member of The Self Managed Super Fund Professionals Association of Australia and has acted as a director of the Victorian Bar Superannuation Fund since 2000. He is Chairman of the Superannuation Section of the Commercial Bar Association.
